END USER LICENSE AGREEMENT (EULA)

This EULA governs your use of the RIVOTECH mobile and web-based application (the “App”), which provides employee and commuter transportation management services to customers, their employees, and related stakeholders (the “End User(s)”).

1. Acceptance of Terms

By installing, accessing, or using the App, you accept and agree to be bound by this EULA. If you do not agree with these terms, do not use the App.

If you are using the App on behalf of an organization, you confirm that you are authorized to accept these terms on its behalf.

2. Permitted Use

The App is provided to facilitate secure and optimized transport scheduling, route tracking, live trip monitoring, and commute planning as part of services offered to your employer by RIVOTECH.

The App may include features such as:

  • Live tracking of cabs or buses

  • Panic button (SOS) feature (network-dependent)

  • Trip alerts and attendance

  • Driver/Passenger coordination

  • OTP-based boarding validation

The Panic Button is a supportive feature that relies on internet, device, and software availability. It is not a substitute for emergency services or security protocols defined by your employer. RIVOTECH is not liable for incidents arising from misuse or malfunction of this feature.

3. License Grant

RIVOTECH grants you a limited, non-exclusive, non-transferable, revocable license to use the App solely in accordance with this EULA and the intended business purposes of your employer.

4. Restrictions

You agree not to:

  • Reverse engineer, decompile, or disassemble the App.

  • Modify, adapt, translate, or create derivative works based on the App.

  • Circumvent any technology used to protect the App.

  • Use the App for unlawful or unauthorized purposes.

  • Sell, rent, or lease any part of the App.

5. Data Collection and Use

By using the App, you agree to our Privacy Policy. RIVOTECH may collect and process the following information:

  • Personal identifiers: Name, phone number, employee ID, email

  • Commute data: Routes, boarding times, attendance, locations

  • Device data: IP address, OS, device model, logs

Purpose of data collection:

  • To facilitate route planning and trip scheduling

  • To verify user identity and boarding (via OTP or GPS)

  • To enable emergency contact or alert features

  • To assist employers in compliance, reporting, and safety

  • To improve the services, monitor usage, and ensure service integrity

Location data is only tracked during active trips and will be securely transmitted and stored per employer’s contract terms. RIVOTECH does not use collected data for advertising or commercial resale.

6. Intellectual Property

The App, including all content, UI, designs, and functionalities, is the intellectual property of RIVOTECH. You agree not to copy, distribute, or exploit the App’s features without prior written consent.

7. Termination

Your rights under this license will terminate automatically if you fail to comply with the terms. You may also stop using the App at any time. RIVOTECH reserves the right to suspend or terminate your access without notice for breach, misuse, or fraud.

8. Warranty Disclaimer

The App is provided “AS IS” and “AS AVAILABLE”. RIVOTECH does not warrant that:

  • The App will be error-free or uninterrupted

  • The App will meet your expectations or requirements

  • Data transmitted through the App will be completely secure

We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, RIVOTECH shall not be liable for:

  • Any direct, indirect, incidental, or consequential damages

  • Any loss of data, revenue, or reputation

  • Delays, service interruptions, or failures due to third-party networks, employer configurations, or technical faults

  • Any harm arising from use or misuse of Panic Button or other features

10. Updates and Modifications

RIVOTECH may periodically update the App or these Terms. Continued use of the App post-update implies your consent to the modified Terms.

11. Governing Law

This EULA shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Hyderabad, Telangana.
